!enquiries IOPC reference: 2021/154205 Savanna, Regarding your response, received today, 9th July 21, I am baffled that West Midlands Police (abbreviated to WiMP in correspondence) can be allowed to get away with ignoring my complaints; it is true that I went through the appeal process in respect of 'Sarah's Stitch-Up' (and I understand that a possible Judicial Review is the next step there), but I have three other complaints, not yet appealed - surely I'm entitled to a response from these, am I not? I am asking the IOPC to investigate the Force (publicity concedes that I "can also complain about how a police force is run") as a pattern seems to have emerged of unfair discrimination; this has recently been confirmed with the local authority's CCTV review team stating that images of an attack in which I was 'kicked about Chapel Street', though incomplete, were "clear" - but WiMP consider that they cannot identify my assailants! It is possible that members of the Force consider I deserve a kicking, though I cannot think why, except in that I am stridently anti-dog, with my violent neighbour's revolting pet, for example, toileted on the High Street, whereas I perform in a toilet bowl! DAustin PS: I am reluctant to indulge an expensive Judicial Review partly because the British Judiciary have proven themselves to be something of a Bad Joke, and is it the case that even if the England Soccer Team are crowned Champions in Sunday's Final, England as Country will remain a Disgusting Dog-Dump? From: !enquiries (enquiries@policeconduct.gov.uk) Date: 07/09/21 14:34 To: mail@dwaustin.net (mail@dwaustin.net) Subject: IOPC reference: 2021/154205 Dear David Austin Thank you for contacting the Independent Office for Police Conduct (IOPC). We acknowledge your email dated 01 July 2021. The case reference number is 2021/154205, which you should quote in all future correspondence. From your email, I note that your complaint was subject to an appeal within West Midlands Police in 2020. Please note, an appeal offers a final opportunity to consider whether the complaint could have been handled better at a local level and, where appropriate, to put things right. Whilst I note you remain dissatisfied with the decision made by West Midlands Police regarding your complaints, the Police Reform Act governing complaint procedures does not afford you a further right of appeal against this decision through the Professional Standards Department (PSD) of West Midlands Police or the IOPC. Should you remain unhappy with the outcome, the correct way to challenge this would be through the process of Judicial Review, where you ask a judge to review the handling of the complaint to ensure that correct processes have been followed. You can find some details on the following link: www.justice.gov.uk/courts/rcj-rolls-building/administrative-court/applying-for-judicial-review. Please be aware, the Judicial Review process must be started within 3 months of a decision being made. As the 3 month time period has passed, you may be able to begin the process of a Judicial Review, however you will need to give representations as to why the process was not started within the 3 month time period after the finalisation letter from the from the appeal body. For further information on this process please seek independent legal advice. Furthermore, please note that the IOPC does not get involved with criminal matters i.e. we have no power to intervene in or change the outcome of a criminal investigation – we only deal with cases of police misconduct. I can only suggest that you contact the police force directly to report any crimes or receive any updates on ongoing criminal matters via 101. I appreciate this may not be the response you were hoping for, however the IOPC must act within the remit of its legislation.
